State Administration of Work Safety: It is not allowed to store fireworks in the same building where residents live.

  CCTV News:According to the website of the State Administration of Work Safety, the State Administration of Work Safety announced today the full text of the Safety Regulations on the Production and Operation of Fireworks and Firecrackers. The "Regulations" point out that retail operators of fireworks and firecrackers are not allowed to operate or store fireworks and firecrackers in the same building where residents live; Dangerous goods production areas and general warehouse areas of production enterprises and wholesale enterprises shall ensure that people are on duty 24 hours a day, and keep effective monitoring facilities and smooth communication.

  "Fireworks production and operation safety regulations" has been considered and adopted at the 16th director’s office meeting in state administration of work safety on December 11th, 2017, and shall come into force on March 1st, 2018.

  The "Regulations" pointed out that fireworks production enterprises, wholesale enterprises and retail operators are collectively referred to as production and business units. The production and business operation entity shall implement the main responsibility of production safety, and its main person in charge (including the legal representative and actual controller, the same below) is the first person responsible for the work of production safety of the entity.

  The production and business operation entities shall meet the conditions for safe production stipulated by relevant laws, administrative regulations, national standards or industrial standards, and obtain corresponding administrative licenses according to law.

  Production enterprises and wholesale enterprises shall establish and improve the safety production responsibility system for all employees, establish and improve the safety production responsibility system, and formulate and implement safety production rules and regulations and operating procedures that conform to laws, administrative regulations, national standards or industry standards.

  After the publication of the new national standards and industry standards, production enterprises and wholesale enterprises shall check the conformity of the overall layout, process flow, dangerous workshops (warehouses), safety protection barriers, fire prevention, lightning protection and anti-static infrastructure and safety management systems of the enterprises, and take corresponding improvement and perfection measures according to the new national standards and industry standards.

  The "Regulations" put forward that production enterprises should actively promote the technological progress of fireworks production, adopt intrinsically safe, reliable and highly automated machinery and equipment and production processes, and use safe and environmentally friendly production raw materials. It is forbidden to use production processes, machinery and equipment and raw materials that are explicitly prohibited or eliminated by the state. Employees are prohibited from bringing tools and equipment into enterprises to engage in production operations.

  The production and business operation entities shall train the employees of their own units on the safety knowledge of fireworks and firecrackers, post operation skills, etc., and employees who have not received education and training in safety production shall not be allowed to work at their posts. Special operators such as dangerous process operations shall obtain corresponding qualifications according to law before taking up their posts.

  The "Regulations" point out that production enterprises can apply for the establishment of wholesale enterprises and retail business premises according to law. Wholesale enterprises can apply for the establishment of retail business premises according to law.

  Production and business operation entities shall organize production and business operation activities in strict accordance with the scope approved by the safety production license or business license. It is forbidden to engage in the production, operation and storage of fireworks and firecrackers outside the place specified in the license, and it is forbidden to continue to engage in production and operation activities after the license expires. Prohibit the sale of excessive, illegal fireworks products or illegal fireworks products.

  Production enterprises shall not sell semi-finished fireworks and firecrackers to other enterprises, shall not buy semi-finished fireworks and firecrackers from other enterprises and sell them after processing, and shall not buy finished fireworks and firecrackers from other enterprises and sell them after affixing the label of the enterprise.

  Wholesale enterprises shall not sell professional fireworks and firecrackers to retail operators or individuals.

  Retail operators are not allowed to operate or store fireworks and firecrackers in the same building where residents live.

  The "Regulations" emphasize that production enterprises and wholesale enterprises must establish a duty system and an on-site inspection system, fully grasp the safety production situation such as the number of personnel and drug distribution in each post on that day, ensure that there is no over-staffing, and deal with abnormal situations in time.

  Dangerous goods production areas and general warehouse areas of production enterprises and wholesale enterprises shall ensure that there are people on duty 24 hours a day, and keep effective monitoring facilities and smooth communication.

  The "Regulations" pointed out that in the purchase and sale of fireworks and firecrackers, production enterprises and wholesale enterprises should sign standardized fireworks and firecrackers sales contracts in accordance with the law, establish fireworks and firecrackers sales contracts and flow management systems, use the national unified fireworks and firecrackers flow management information system, and truthfully register the flow of fireworks and firecrackers.

  The "Regulations" require that local safety production supervision and management departments at all levels should strengthen supervision and inspection of production and business units within their respective administrative areas, clarify the main body of safety production supervision and management of each production and business unit, formulate and implement the annual supervision and inspection plan, and impose administrative penalties on illegal production of production and business units according to law.

  These Provisions shall come into force as of March 1, 2018.
